Terms & Conditions

1) Purchase Contract:

This web site is operated by marine aquatics. All purchases made on this web site are governed by these Terms and Conditions at any time although the Terms and Conditions governing any given purchase will be those in effect at the date of your order. If you order goods after we have published the changes you will be bound by those changes. Accordingly, you should check prior to each order to ensure that you understand the precise terms and conditions applicable to your purchase. To assist you in determining whether the Terms and Conditions have changed since your most recent order we will display the date when these Terms and Conditions were most recently updated.

We will confirm acceptance of your order. This will occur either by message on the website immediately after you have confirmed your order, or by us sending an e-mail to the email address you have provided to us. We may do both, in which case the acceptance will occur on whichever arrives sooner of the web message and the email. At this point the purchase contract will be made and we will supply the goods to you in accordance with your order and these Terms and Conditions. All goods remain the property of marine aquatics until payment is received.

2) Ordering:

All orders for Goods shall be deemed as an offer by the Buyer to purchase Goods pursuant to these Terms and Condition subject to acceptance by the Seller. The Seller may choose not to accept an order for any reason.

Where the Goods ordered by the Buyer are not available from stock the Buyer shall be notified and give the option to either wait until the Goods are available from stock or cancel the order and receive a full refund within 10 days. In terms of some inverts we reserve the right to from time to time substitute when a species is unavailable from our suppliers, and the replacement will always be of equal or higher value and suitable for the task intended.

Any special order or custom made piece of equipment can only be returned if faulty and this will be determined by the manufacture as to the fault and its cause and repaired or replaced as necessary.

Gift cards are non transferable and non refundable once issued.

3) Warranty:

The Seller warrants that the Goods will at the time of dispatch correspond to the description given by the Seller. Except where the Buyer is dealing as a Consumer, all other warranties, conditions, or terms relating to fitness for purpose, merchantability or the condition of the Goods, whether implied by the Statute, common law or otherwise are excluded, and the Buyer is satisfied as to the suitability of the Goods for the Buyer’s purpose.

4) Delivery:

The Seller shall use all reasonable endeavors’ to meet any date agreed for delivery. In any event time of delivery shall not be of the essence and the Seller shall not be liable for any losses, costs, damages or expenses incurred by the Buyer or any third party whether directly or indirectly out of any failure to meet the estimated delivery date.

Delivery of the Goods shall be made to the Buyer’s address specified in the order and the Buyer shall make all the arrangements necessary to take delivery of the Goods whenever they are tendered for delivery.

Title and risk of the Goods shall pass to the Buyer upon delivery of the Goods.

All goods must be inspected on receipt and the seller notified within 24 hours of receipt of any damages via phone or in writing. All goods should be inspected before signing the delivery companies paperwork.

Please note free shipping over £65 applies to Uk mainland only, Uk highlands and other Uk Islands extra shipping costs may have to be applied depending on order size and weight and zone these charges will be advised once shipping weights and size and costs are calculated for you.

If you are not Uk mainland then there is very limited free shipping unfortunately all courier services have different charges and prices for different UK zones and will do our very best to choose the most appropriate for your order and advise you of those costs if necessary.

You will however receive your free UK shipping charge towards any extra charge which will be £4.50 for orders under 1kg and £7.95 for all others up to 30kg towards your total shipping costs if your orders are over £65.

5) Cancellation:

The Buyer shall inspect the Goods immediately upon receipt and shall notify the Seller within 2 working days of delivery if the Goods are damaged or do not comply with any of the Contract. If the Buyer fails to do so they shall be deemed to have accepted the Goods.

Where a claim of defect or damage is made the Goods shall be returned to the Buyer by the Seller. The Buyer shall be entitled to a full refund (including delivery costs) plus any return postal charges if the Goods are in fact proven defective once they have been inspected by the manufacturer.

If you are a consumer you have the right, in addition to your other rights, to cancel the Contract and receive a refund by informing the Seller within 7 working days of receipt of the Goods, excluded from this are any special order items, sales items and any livestock.

Goods must be returned by the Buyer at the Buyer’s expense and should be adequately insured during the return journey. A Buyer will receive a full refund of all monies paid for the Goods (excluding delivery charges, if any) except for return postal charges within 28 days of cancellation. If the Buyer fails to return the goods following cancellation, the Seller shall be entitled to deduct the cost of recovering the Goods from the Buyer. Goods sent to the customer on a free delivery offer and subsequently cancelled / returned by the buyer under consumer law will be liable to a £8.50 delivery charge which will be deducted from any refund made.

Abandoned Goods: Any goods returned to us at our premises without documentation included which easily identifies the original purchaser of the goods will be treated as being abandoned to us.

Any order placed and not collected within six months of the original order date will be treated as abandoned.

When returned Good are found to be damaged due to the Buyer’s fault (including incorrect usage) the Buyer will be liable for the cost of remedying such damage.

Pictures on the website are purely for illustration purposes, occasionally suppliers change specifications / design.

Any card payment refund requests are unfortunately subject to charges made by the card company (not by ourselves!!) on processing the payments back to the card holder! and this can range from 1.25% to 2.25% of the purchase total depending on card used and card providers.

6) Special Order / Non-stock items:

Any overseas orders or none stock special ordered items cannot be cancelled after they have been dispatched. Any packed, ready to ship overseas orders that are subsequently cancelled will incur a up to a 20% restocking charge depending costs incurred for purchasing and shipping said items.

7) Prices:

All prices are in UK Pounds and are inclusive of VAT where applicable, at the current rate of 20%. The price of the goods will be as quoted on the web site at the time you confirm your order (usually by clicking the “checkout” button) subject only to any inadvertent technical error for which we will not be liable. If you subsequently amend your order, the prices charged will be those applicable to the amended item(s) at the time that the amended order is confirmed. Please note that as promotions are offered for a limited period of time subsequent amendments to your order may mean that certain promotions are no longer being offered.

The price of the goods does not include a charge for delivery.

8) Availability:

Although we endeavour to hold stock of all the items advertised for sale on our site this cannot be guaranteed due to in-store sales so that by acknowledging receipt of your order we are not creating a binding contract to supply what you have ordered and which we do not have in stock. The content of the site is managed and therefore any products that are out of stock should be highlighted this may not be applied in all cases again to in-store sales of those items.

In the event of unavailability of an item for whatever reason, we will advise you of our position when we receive your order at the earliest opportunity normally within 24hrs of receipt of order except for weekends and Mondays (store is closed on Mondays) and we will await your subsequent instructions on how to proceed with your order.

9) Price Promise:

We endeavour to maintain our prices as competitive as possible so we will refund price difference on products if proven by buyer that a product is cheaper from another retail supplier and not an online supplier and that the product is not on special offer or involved in any other offer offered by the supplier which would make product cheaper than otherwise would be.

10) Special Offers

All special offers and deals will apply to both in store and online purchases when running but will exclude all finance applications and all other items already on offer. Purchases are subject to stock and availability with in store purchases so please check if travelling to store before doing so.

Usage of sale coupons and discount codes is strictly limited to 1 sale per user or 1 transaction per user.
